Think You Own the Beach? Think Again.

Bold move: Gov. Ron DeSantis just reversed Gov. Rick Scott’s 2018 law that gagged local governments on beach access.

That means local communities on 30A are now empowered to protect public access—and your property value.

In 2018, Rick Scott signed a law (HB 631) that made it harder for local governments to keep public access to privately owned beaches.

It required them to go to court, parcel by parcel, to prove the public had a right to use certain beach areas—a slow, expensive process that led to more “Private Beach” signs and less access for locals and visitors.

The new law signed by Gov. DeSantis on June 24th, 2025 repeals that restriction.

Now, local governments can once again pass “customary use” ordinances on their own—restoring their power to protect long-standing public beach access without needing court approval first.

In short: It gives control back to local communities and helps protect the tradition of shared beach access in places like 30A.

  • Local control is back. Pre-SB 1622, any ordinance letting people walk, fish, or sunbathe on dry sand had to be litigated parcel by parcel. No more red tape.
